Rental Agreement & Policies
Haye Productions LLC
These Rental Agreement & Policies apply to equipment rented from Haye Productions LLC ("Haye Productions," "Company," "we," or "us"). The customer, individual, company, or organization renting the equipment is referred to as the "Renter."
The equipment included in each rental is identified on the applicable rental order, estimate, invoice, or agreement. Additional requirements may apply depending on equipment value, rental type, delivery requirements, customer history, venue, and event requirements.

1. Rental Period & Returns
The rental period begins on the agreed pickup or delivery date and time and ends on the agreed return date and time shown on the rental order or agreement.
Equipment must be returned on time and in substantially the same condition in which it was provided, ordinary wear excepted.
Equipment returned after the agreed return date or time may be subject to additional rental charges at the applicable daily or prorated rental rate, as well as reasonable costs caused by the delayed return, including labor, rescheduling, or documented lost-rental costs where applicable.
Rental extensions must be approved by Haye Productions LLC before the original scheduled return time.
2. Reservations, Payment & Security Deposits
A deposit may be required to reserve equipment. Unless otherwise agreed in writing, full payment is required before equipment is released or delivered.
Depending on the rental, Haye Productions LLC may require one or more of the following:
- Valid driver's license or government-issued identification
- Valid credit card
- Security deposit or credit card authorization
- Certificate of Insurance
- Replacement-value deposit or other security
- Signed rental agreement
Any refundable security deposit will be released after the equipment has been returned, inspected, and all outstanding charges have been satisfied, subject to applicable processing times.
3. Customer Responsibility & Proper Use
The Renter assumes responsibility for rented equipment from the time it is picked up or delivered until it has been returned to and accepted by Haye Productions LLC.
Equipment must be used only for its intended purpose and operated in accordance with manufacturer instructions and any instructions provided by Haye Productions.
The Renter may not sublease, transfer, modify, misuse, or permit unauthorized persons to operate rented equipment.
The Renter is responsible for providing appropriate electrical service, properly grounded power, safe operating conditions, and reasonable protection from unauthorized access.
4. Outdoor Use, Weather & Environmental Conditions
Equipment may not be exposed to rain, standing water, excessive moisture, extreme heat, unsafe wind conditions, or other conditions for which the equipment is not designed.
The Renter is responsible for providing appropriate weather protection whenever equipment is used outdoors unless Haye Productions has specifically agreed in writing to provide such protection.
Weather-related damage occurring while equipment is in the Renter's possession may be charged to the Renter.
Haye Productions reserves the right to suspend operation or remove equipment when conditions present a reasonable safety risk to personnel or equipment.
5. Loudspeakers, Subwoofers & Equipment Abuse
The Renter is responsible for damage caused by misuse, improper gain structure, excessive signal levels, clipping, improper processing, incorrect connections, unauthorized modification, inadequate or improper power, or operation outside the equipment's intended limits.
Damage to loudspeaker drivers, compression drivers, amplifiers, subwoofers, electronics, connectors, or other components resulting from misuse or abuse may be charged at the applicable repair or replacement cost.
Normal equipment failure not caused by misuse, abuse, improper operation, or external conditions remains the responsibility of Haye Productions.
6. Damage, Loss & Theft
The Renter is responsible for rented equipment while it is in the Renter's possession or control.
The Renter may be responsible for reasonable costs associated with:
- Repair of damaged equipment
- Replacement of lost, stolen, destroyed, or uneconomically repairable equipment
- Missing cables, accessories, cases, hardware, or components
- Cleaning beyond normal use
- Shipping, programming, configuration, or other costs reasonably necessary to restore or replace equipment
- Applicable loss-of-use charges
Theft must be reported promptly to Haye Productions and law enforcement. A police report may be required.
7. Replacement Value & Loss of Use
Equipment that is lost, stolen, destroyed, or damaged beyond economical repair may be charged at its current replacement cost, including reasonable associated costs required to replace and restore the equipment to service.
When damaged, lost, or stolen equipment cannot reasonably be rented to other customers, Haye Productions may seek reasonable loss-of-use damages for the period required to inspect, repair, replace, ship, configure, or return the equipment to rentable condition, to the extent permitted by applicable law.
8. Late Returns & Failure to Return Equipment
Late rental charges may continue until all equipment is returned and accepted by Haye Productions or an extension is approved in writing.
If equipment has not been returned within 24 hours after the agreed return time, Haye Productions may contact the Renter, assess applicable extended-rental charges, and pursue recovery of the equipment.
If equipment remains unreturned for 72 hours or more without an approved written extension, Haye Productions reserves the right to treat the equipment as unreturned, pursue recovery, assess applicable replacement charges, and exercise any remedies available under applicable law.
9. Delivery, Setup & Technician Services
When Haye Productions provides delivery, setup, operation, or strike services, the customer and venue must provide safe and timely access to the work area, suitable electrical service, and any required venue permissions.
Additional charges may apply for:
- Stairs or difficult access
- Extended equipment pushes or unusual load-in conditions
- Parking, tolls, permits, or loading restrictions
- Delayed access or extended labor
- Additional setup or strike requirements
- Changes to the agreed scope of work
When the Renter declines setup or technician services, the Renter assumes responsibility for proper installation, connection, operation, and safe use of the equipment.
10. Insurance & Certificate of Insurance
Haye Productions may require insurance depending on the value of the equipment, nature of the rental, customer history, venue, or event.
A Certificate of Insurance may be required before equipment is released. Haye Productions may require appropriate liability coverage and equipment/property coverage and may require Haye Productions LLC to be named as an Additional Insured and/or Loss Payee where appropriate.
Failure to provide required insurance documentation does not relieve the Renter of responsibility for loss, theft, damage, or other amounts properly due under the rental agreement.
For certain rentals, Haye Productions may approve alternative security arrangements, including a security deposit, replacement-value authorization, or other mutually agreed protection.
11. Cancellation & Rescheduling
Unless different cancellation terms are stated on the applicable rental order, estimate, invoice, or agreement:
- Cancellations made 7 or more days before the event may be eligible to have the reservation deposit transferred once to another date within 90 days, subject to availability.
- Cancellations made within 7 days may result in forfeiture of the reservation deposit.
- Cancellations made within 48 hours may be subject to the full rental amount.
Cancellations and rescheduling requests must be submitted in writing.
12. Unpaid Balances & Collections
The Renter remains responsible for rental charges and other amounts properly due under the rental agreement, including applicable late charges, repair costs, replacement costs, and other agreed charges.
Unpaid balances may be referred for collection or legal recovery. Haye Productions reserves the right to seek reasonable collection costs, court costs, attorney fees, and interest to the extent permitted by applicable law.
13. Credit Card Authorization
Where a separate credit card authorization is executed, Haye Productions may charge authorized amounts due under the rental agreement, including unpaid rental balances, approved extended-rental charges, damage, cleaning, repair, replacement, or other properly documented amounts covered by that authorization.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Haye Productions will not be responsible for indirect or consequential losses arising from circumstances outside its reasonable control, including event interruption, lost revenue, venue restrictions, utility failure, severe weather, or third-party vendor failure.
Nothing in these policies is intended to exclude or limit liability that cannot legally be excluded or limited.
15. Indemnification
To the extent permitted by applicable law, the Renter agrees to be responsible for claims, damage, or injury arising from the Renter's misuse, unauthorized modification, improper installation, or unsafe operation of rented equipment.
Additional indemnification requirements may be included in a project-specific rental or production agreement.
16. Force Majeure
Haye Productions is not responsible for failure or delay in performance caused by circumstances reasonably beyond its control, including severe weather, natural disasters, government orders, venue closures, utility failures, emergencies, or similar events.
17. Governing Law
The rental agreement and these policies are governed by applicable law, including the laws of the State of New Jersey where applicable.
18. Rental Order & Additional Terms
The applicable estimate, invoice, rental order, signed rental agreement, or production agreement may contain additional or project-specific terms.
If a specific written agreement signed by Haye Productions and the Renter contains terms that differ from these general website policies, the specific written agreement will control for that rental to the extent stated in that agreement.
19. Acceptance
By completing a rental transaction and, where required, signing a rental agreement or acknowledging these policies electronically, the Renter confirms that they have had an opportunity to review the applicable rental terms.
